Documents Necessary To File

This is not an exhaustive list, rather this will change based on the estate's needs.

Decedent and Fiduciary Information:

  • Certified copy of the death certificate.

  • Copies of the decedent's will, trust documents, and any prenuptial or buy-sell agreements.

  • Decedent's SSN, date of birth, date of death, and domicile at the time of death.

  • Name, address, and SSN/EIN of the executor.

  • Certified copies of letters of testamentary or administration.

  • Information on any predeceased spouse (including a copy of their Form 706 if they filed one to elect portability).

Asset and Debt Information:

  • List of all assets owned by the decedent at the time of death, including real estate, bank accounts, stocks, bonds, business interests, and life insurance policies.

  • Appraisals or valuation documents for all assets.

  • List of all debts owed by the decedent (mortgages, credit cards, etc.).

  • Records of expenses of the estate, such as funeral expenses, medical bills, and administrative costs.
